Breaking a Pan Am Equities Lease: Assignment or Re-Rental?

Leaving a Pan Am Equities apartment before your lease ends? Learn how the assignment process works so you can handle it smoothly.

The short answer

If you still have possession of the apartment, you can find a renter subject to Pan Am's approval. If you move out first, Pan Am starts looking for a new tenant after you return the keys. You remain responsible for rent until a new tenancy begins or your lease expires, whichever comes first.

This guide is based on Pan Am instructions from Pan Am lease assignments I've handled. Policies can change, so get the current terms from the Leasing Department before you advertise or set a move date.

Step 1 · Contact Pan Am

Ask the Leasing Department for the assignment instructions.

Ask for the application steps, listing restrictions, and earliest possible assignment date. Most importantly, ask what must happen before your rent responsibility ends.

Email template

“I need to leave apartment [number] before my lease ends on [date]. Please send the current assignment instructions and confirm the rent, remaining term, application requirements, approved marketing channels, security-deposit process, and earliest possible assignment date.”

Choose the route

The timing of Pan Am's search depends on who is finding the replacement.

A lease assignment can be the cost-effective option if you have enough time. You can market the apartment, speak with prospective renters, and try to get someone approved before you leave. Once you return the keys, Pan Am controls the search. You may keep owing rent without knowing how long the search will take.

Still living there? Try the assignment route first if your timeline allows it. If you have to leave before an assignment is finished, get the re-rental procedure in writing and keep proof that you returned the keys. Continue checking the ledger until Pan Am confirms that a new tenancy has begun or your lease has expired.

Step 2 · Find the assignee

Market the lease you actually have left.

The incoming renter is applying to take over the rest of your lease. Give them the terms up front: the approved rent, lease end date, proposed start date, apartment condition, and pet rules. The listing should also say that Pan Am must approve the assignment.

01

Use confirmed terms

Do not guess at the rent, dates, incentives, or fees Pan Am will approve.

02

Pre-screen the applicant

Check income, credit readiness, rental history, documents, pets, guarantor needs, and timing.

03

Keep dates conditional

An application or conditional approval is not permission to move in.

Build one accurate listing brief before publishing

  • Economics: approved rent, remaining term, target start date, deposit, and any confirmed fees.
  • Apartment: actual photos, layout, condition, light, view, storage, amenities, and anything staying behind.
  • Applicant: expected qualifications, possible guarantor, pets, funds, and available documents.
  • Process: Pan Am approval, permitted advertising channels, final approval, and the building's move rules.

Step 3 · Follow the listing rules

Use your own accurate photos and avoid prohibited platforms.

Pan Am does not typically supply professional photos for a tenant's assignment listing. It has also prohibited these listings on the Nestio family of platforms. Ask whether that rule is still current, and check where your listing service sends its ads. A post on one site may appear on several others.

  • Photograph the actual apartment: show its light, layout, view, finishes, storage, and current condition.
  • Identify the transaction: say that it is a Pan Am lease assignment subject to management approval.
  • Control syndication: confirm where the listing will appear before it goes live.
  • Promise only confirmed dates: the move cannot be scheduled until final approval.

Step 4 · Application and approval

The incoming renter must complete a full application.

In Pan Am assignments I've handled, the applicant still had work to do after receiving conditional approval. Pan Am requires tenant screening, employment and residence checks, recent rent history, supporting records, closing funds, and signed lease documents. A renter who gathers these items early is less likely to get stuck near the finish line.

  • Screening: credit, employment, residence, and guarantor review when applicable.
  • Rental history: proof of recent on-time rent payments in the format management requests.
  • Supporting files: submit complete, legible PDFs rather than screenshots when instructed.
  • Transaction documents: the file may include a W-9, pet form, lease, riders, and guarantor paperwork.
  • Closing funds: follow the current payee, payment method, and delivery instructions exactly.

Conditional approval is not final approval. The incoming resident should wait for the landlord's final approval before booking movers or reserving an elevator.

Step 5 · Money and handoff

Confirm every payment and responsibility date in writing.

  • Incoming resident: Pan Am's instructions call for first month's rent and a new security deposit.
  • Outgoing security: Pan Am returns the departing tenant's deposit after the outgoing lease ends to the forwarding address provided, subject to the final account and condition.
  • Mid-month proration: confirm the amount, dates, payer, and payee; if the tenants settle directly, document it in writing.
  • Responsibility date: the signed documents should identify when the outgoing tenant's obligation ends and the incoming resident's begins.

The outgoing and incoming tenants also need to work out the physical handoff. Agree on cleaning, apartment condition, items left behind, keys, building access, and the move schedule before the lease is signed to ensure a smoother process.

The alternative · Re-rental after move-out

Returning the keys starts Pan Am's search; it does not end the lease that day.

If you leave without a completed assignment, Pan Am begins looking for a replacement after you vacate and return possession. Their instructions say you remain responsible for rent until a new tenancy begins or the original lease expires, whichever happens first.

  1. 1

    Give written notice

State the move date and ask for the key-return, inspection, and re-rental instructions.

  2. 2

    Document the surrender

Photograph the apartment, return every key as directed, and obtain written confirmation of possession.

  3. 3

    Track the replacement date

Keep the rent ledger and ask management to confirm when the new tenancy begins and your responsibility ends.

New York's duty-to-mitigate law requires a residential landlord to make reasonable, good-faith efforts to re-rent after a tenant leaves in violation of the lease. Once the new lease takes effect, the prior lease ends. Returning the keys alone does not have the same effect.

Avoidable delays

Five mistakes that increase the risk of extra rent or a failed assignment.

  1. 1

    Moving before choosing the route

Pan Am's own re-rental effort starts after possession is returned. Decide whether you have time to pursue an assignment first.

  2. 2

    Publishing on an unapproved channel

Confirm any advertisement you make is compliant with their advertisement restrictions.

  3. 3

    Treating conditional approval as final

Open document, payment, guarantor, pet, or signature conditions can still delay or stop the transaction.

  4. 4

    Booking the move too early

Wait for final approval, then confirm the building's elevator, insurance, access, and key-transfer requirements.

  5. 5

    Losing the paper trail

Keep the approval, signed documents, payment receipts and paperwork together.

Assignment timeline

A Pan Am assignment usually moves through five steps.

  1. 1

    Confirm the terms

Get the approved rent, dates, criteria, fees, and listing rules from the Leasing Department.

  2. 2

    Market compliantly

Use accurate photos and approved channels while you still possess the apartment.

  3. 3

    Application Process

Upload the requested documents and complete the application.

  4. 4

    Sign and pay funds

Execute the lease documents, deliver funds as instructed, and wait for final approval.

  5. 5

    Close the handoff

Confirm responsibility, security, proration, apartment condition, keys, and the move.

Frequently asked questions

Pan Am Equities lease-break and assignment questions.

Can I break a Pan Am Equities lease early?

You have two main options. While you still have the apartment, you can find someone to apply for an assignment. If you move out first, Pan Am will begin its own search after you return the keys. Moving out does not end your rent responsibility on its own.

Does Pan Am Equities charge a fixed lease-termination fee?

Pan Am’s current instructions say there is no fixed termination fee. If you leave without completing an assignment, you remain responsible for rent until the earlier of a new tenant being found or the original lease expiration.

Does Pan Am Equities allow lease assignments?

Yes. While you remain in possession, you may find a qualified applicant for Pan Am to screen. If the applicant receives final approval and the documents are completed, the new resident takes over the remainder of the lease.

Will Pan Am show the apartment before I move out?

Pan Am’s instructions say management will not begin its own showings until you have vacated, returned the keys, and given back possession. That is separate from a tenant-led assignment search conducted before move-out.

What does a Pan Am assignment applicant need?

The applicant goes through a full tenant review. Pan Am may ask for employment, residence, rental history, and financial records. The final file can also include guarantor documents, a W-9, pet paperwork, certified funds, and electronic lease riders.

Can I advertise a Pan Am assignment anywhere?

No. Pan Am’s instructions prohibit tenant assignment listings on the Nestio family of marketing platforms, and management does not provide professional listing photos. Confirm the approved channels before marketing because platform and syndication rules can change.

Is conditional approval the same as final approval?

No. A conditional approval means something is still open. It may be screening, documents, funds, a tax or pet form, or signed lease paperwork. The incoming resident should wait for final approval before scheduling the move.

What happens to the outgoing tenant’s security deposit?

Pan Am’s assignment instructions say the incoming resident provides first month’s rent and a new security deposit. Pan Am’s public FAQ says the outgoing deposit is generally issued within 14 days after lease expiration or possession is returned, whichever is later, subject to the final account and apartment condition. Confirm how the assignment’s effective date will be treated and provide a forwarding address.

How long am I responsible for rent after leaving a Pan Am apartment?

The early-move-out instructions reviewed for this guide say rent remains your responsibility until a replacement tenancy begins or your original lease expires, whichever comes first. Returning the keys starts Pan Am’s search. It does not release you by itself. Ask for the new tenant’s start date and your final ledger in writing.

Who handles the keys in a Pan Am lease assignment?

Pan Am’s published move-out instructions for at least one property say the outgoing and incoming tenants coordinate the key handoff directly because management does not exchange keys for assignments or takeovers. Procedures and move rules vary by building, so confirm the exact handoff with the Leasing Department and building staff.
