Breaking a Dermot Lease: Assignment or Sublet?

How to approach a Dermot lease exit using current 20 Exchange and 66 Rockwell assignment evidence: route, application, costs, approval, and release.

The short answer

If you need to leave a Dermot apartment early, an assignment is a credible route—not a hypothetical one. In September 2026, Dermot's own 20 Exchange leasing team listed an occupied apartment as a lease assignment with a defined October-to-May term. Earlier public transactions also document assignments at 20 Exchange and 66 Rockwell. The exact property must still approve the route, applicant, economics, documents, and release in writing.

Evidence hierarchy

Dermot’s own current assignment listing is the strongest public signal.

Transaction evidence answers “does this happen?” It does not answer “will my lease qualify?”

Confirm the property and landlord entity

Dermot owns some assets and manages others, so building identity matters.

Dermot describes more than 30 years of multifamily investment, ownership, and management. Its current New York collection includes 20 Exchange, 66 Rockwell Place, 101 West End, 21 West End, 535 West 43rd, The Landon, The Buchanan, The Chrystie, The Kestrel, The Addison, MODA, The Vitagraph, and other buildings.

  • Read the landlord and notices clause in the signed lease.
  • Confirm whether Dermot is owner, agent, or both for the apartment.
  • Use the current property leasing or management contact, not a generic portfolio assumption.
  • Identify whether the apartment is market-rate, rent stabilized, affordable, or otherwise regulated.

Step 1 · Define the available deal

Ask whether Dermot will offer the remaining term, a new lease, or both.

A useful written request

“I need to leave apartment [number and address] around [date], before the lease ends on [date]. Please confirm whether the owner will consider (a) assignment of the remaining lease, (b) cancellation and a new lease with my replacement, (c) an approved sublet, (d) a household change, or (e) negotiated surrender. Please send the approved rent, term, application, qualification, fees, security, timing, marketing, and release terms.”

A remaining-term option can preserve an attractive rent; a new lease can offer a longer term. Marketing both without permission creates avoidable confusion.

Choose the route

Five possible structures produce different rights and costs.

RouteIncoming renter signsOutgoing tenant’s position
Remaining-term assignmentAssignment and existing lease packageRelease only if the documents provide it
Replacement leaseA new lease from the ownerOld lease ends only through signed termination or surrender
Roommate amendmentLease amendment or new household documentDeparting roommate is removed only as written
SubletSublease under the prime leasePrime tenant usually remains liable
Negotiated surrenderNo replacement necessarilyLiability ends under the surrender’s terms

Current and historical transaction evidence

20 Exchange shows how the remaining-term route can be marketed.

A current StreetEasy listing for apartment 3307 was posted by “The 20 X Leasing Team” at The Dermot Realty Management Company. It expressly labels the apartment a lease assignment, says it is occupied, and identifies dates from October 2026 through May 2027. That is unusually direct management-side evidence.

At 20 Exchange, Dermot publishes a building-specific leasing contact. At 66 Rockwell Place, Dermot likewise publishes a dedicated property contact. Use those channels to validate any listing, application link, and requested payment.

What not to infer: one approved assignment does not establish a universal assignment fee, income multiple, renewal right, deposit method, or release form.

Permanent replacement

Build the assignment around the exact lease—not around the phrase “takeover.”

  • Rent: gross rent, any remaining tenant subsidy, concessions, and recurring charges.
  • Term: effective date, lease expiration, access date, and renewal status.
  • Apartment: condition, furniture, repairs, pets, occupants, and move requirements.
  • Approval: current qualification, application channel, owner consent, and open conditions.
  • Release: which outgoing tenants and guarantors are released, and on what date.

Under Real Property Law § 226-b, assignment requires written owner consent. If the owner reasonably refuses, there is no assignment and no statutory release. If refusal is unreasonable, the statute can provide release on request with 30 days' notice. Obtain legal advice before relying on that remedy.

Roommate and guarantor changes

A partial household change is not automatically a full lease assignment.

If one named tenant leaves and others remain, ask whether Dermot requires a roommate amendment, full household requalification, a new lease, or another structure. Confirm whether the guarantor remains, whether a replacement guarantor is accepted, and whether the departing party gets a signed release. A private roommate agreement cannot remove a person from the owner's lease.

Step 2 · Prepare before the portal opens

Do not publish an invented qualification multiple.

No reliable public Dermot source located for this review states one portfolio-wide income or guarantor multiple. A replacement should be ready with a clean, complete file, but should follow the exact building instructions.

  • Government-issued photo identification for every required adult.
  • Recent pay statements, employment or offer letters, tax records, or self-employment documents as applicable.
  • Complete bank or asset statements if requested, with no altered pages.
  • Rental history, landlord references, credit authorization, and occupancy details.
  • Guarantor or third-party guaranty documents only through an approved route.

Ask for screening criteria before marketing the renter as qualified. A complete file can still be declined for legitimate reasons.

Model the complete economics

Separate advertised rent from the full assignment or replacement-lease cost.

ItemQuestion to resolve
Base rentDoes the existing gross rent continue, or will Dermot set a new lease price?
Tenant incentiveIs any subsidy private, documented, lawful, and payable without changing the lease?
Application and processingWhat can each party be charged, by whom, and when?
SecurityDoes management return, replace, transfer, or credit the deposit?
Concessions and exit chargesAre free rent, legal, surrender, damage, cleaning, or other amounts due?
Broker servicesWho hired the broker and what written agreement governs compensation?

Ask for a current, itemized statement. A historical listing price is not evidence of today's fees.

Temporary absence

Use a sublet only when the prime tenant intends a temporary transfer.

For qualifying apartments in buildings with four or more residential units, § 226-b establishes a written request process. A compliant request generally identifies the term, proposed subtenant, reason, temporary address, co-tenant or guarantor consent, and proposed sublease. Rent-stabilized sublets add rules concerning primary residence, term, rent, and surcharge; review HCR Fact Sheet #9.

Do not use a “sublet” label to disguise a permanent exit. The legal structure, occupancy plan, and responsibility should match.

Closing discipline

Approval is a chain, not a single email.

  1. 1

    Route approval

Dermot or the owner confirms which transaction it will consider.

  2. 2

    Applicant approval

Every required person completes the official process and clears conditions.

  3. 3

    Owner consent and documents

The correct owner party and all tenants, guarantors, and replacements sign.

  4. 4

    Funds and logistics

Rent, fees, security, insurance, inspection, access, and move timing are complete.

  5. 5

    Effective release

The final agreement states when the outgoing parties' liability ends.

If no agreement is reached

Moving out can trigger mitigation, but it does not create consent.

New York Real Property Law § 227-e generally requires reasonable and customary re-rental efforts after a residential tenant vacates in violation of the lease. The former tenant may still face rent loss and other valid charges until the apartment is re-rented or liability otherwise ends.

Before relying on breach, review protected exits in the NYC lease-break guide and consult counsel when the facts are disputed.

Avoidable delays

Five mistakes to avoid in a Dermot lease exit.

  1. 1

Assuming one building proves a portfolio policy

20 Exchange evidence is strong, but the exact property and lease still control.

  2. 2

    Inventing an income requirement

Obtain current screening criteria from the property before advertising.

  3. 3

    Marketing only “takeover”

State whether the approved structure is assignment, new lease, amendment, or sublet.

  4. 4

    Promising renewal

The remaining term and a future renewal are separate decisions.

  5. 5

    Treating approval as release

Liability ends under completed documents, not at the screening stage.

Process overview

A Dermot lease exit moves through seven stages.

  1. 1

    Read the lease

Identify the owner, assignment, sublet, notice, concession, and deposit terms.

  2. 2

    Ask the property

Request the remaining-term and new-lease options plus all other available routes.

  3. 3

    Confirm the deal

Get rent, dates, criteria, fees, renewal language, and marketing permission.

  4. 4

    Find the right renter

Pre-screen against the issued criteria without promising approval.

  5. 5

    Complete the application

Use only the verified property channel and satisfy open conditions.

  6. 6

    Sign and reconcile

Complete documents, funds, deposit accounting, and release.

  7. 7

    Hand over possession

Coordinate condition, inspection, insurance, access, keys, and the move.

Frequently asked questions

Dermot lease-break, assignment, takeover, and sublet questions.

Can I break a Dermot Company lease early?

Possibly, but Dermot does not publish one portfolio-wide early-termination formula on the public pages reviewed. Current evidence shows that lease assignments occur at Dermot properties, especially 20 Exchange, where the Dermot leasing team itself currently markets assignment units. Ask the exact property to compare an assignment, a new lease with the replacement, an approved sublet, a roommate change, and a negotiated surrender.

Does Dermot allow lease assignments?

Current transaction evidence strongly supports that assignments are available in at least some Dermot buildings. A September 2026 StreetEasy listing by The Dermot Realty Management Company advertised a 20 Exchange apartment explicitly as a lease assignment, and other 20 Exchange assignments have been publicly marketed. That is property-level evidence, not a promise that every Dermot lease can be assigned.

Which Dermot properties have assignment evidence?

The strongest current evidence is at 20 Exchange, where Dermot’s own leasing team has marketed assignments with defined remaining-term dates. Public listings also document prior assignments at 66 Rockwell Place, including a rent-stabilized apartment whose applicant was directed to a new-applicant portal. Each listing is evidence of a transaction, not a universal fee, approval, renewal, or release rule.

Is a Dermot lease takeover the same as an assignment?

“Lease takeover” is a marketing phrase. A true assignment transfers the remaining interest in the existing lease. Dermot might instead cancel the old lease and issue a new lease to the replacement renter. The final documents determine rent, term, renewal, concessions, deposit, and whether the departing tenant is released.

What income does a Dermot replacement renter need?

No reliable portfolio-wide Dermot income multiple surfaced in the public sources reviewed. Do not advertise a 40×, 45×, or other threshold without written confirmation from the property. Ask how combined income, guarantors, students, self-employment, assets, credit, rental history, housing vouchers, and any regulated-unit rules are evaluated for the exact transaction.

How much is the Dermot application or assignment fee?

No public Dermot page reviewed stated one universal assignment fee. New York generally caps a landlord’s credit and background-check charge at $20, subject to statutory conditions, but that does not establish the amount or legality of every other transaction charge. Request an itemized property-specific cost sheet before the replacement applies or the outgoing tenant commits.

Can I sublet a Dermot apartment?

Ask the property for written consent and follow the lease and New York Real Property Law § 226-b. For qualifying rentals in buildings with four or more units, the law provides a detailed request process and limits unreasonable withholding. An approved sublet normally leaves the prime tenant responsible for rent and lease compliance.

Can a rent-stabilized Dermot lease be assigned?

Public transaction evidence includes an assignment advertised at 66 Rockwell as rent stabilized, but one listing does not establish a portfolio rule or guarantee renewal rights. Regulated apartments raise additional questions about rent, riders, primary residence, renewal, succession, overcharge, and legal structure. Confirm apartment status and obtain the owner’s documents before making promises.

Does a Dermot assignment preserve the existing rent and term?

It can. Dermot’s current 20 Exchange assignment listing identifies a fixed assignment period, and an earlier 20 Exchange listing described a remaining-term assignment with the lease unchanged. But a replacement lease can use different rent and dates. Ask whether the deal is the remaining lease, a fresh term, or a choice between both.

Can the incoming tenant renew after a Dermot assignment?

Do not promise renewal unless Dermot confirms it in writing. Some historical 20 Exchange assignment listings referenced an option or ability to sign a new lease, but the current lease, apartment status, owner decision, qualification, pricing, and law control. Separate the remaining-term transaction from any later renewal offer.

What documents will a Dermot replacement applicant need?

Use the package issued by the specific property. Prepare government identification, income and employment records, recent bank or asset records, landlord or rental-history information, guarantor materials if applicable, and details for every adult occupant. Regulated or affordable apartments may require additional eligibility documents. Sensitive records should go only through Dermot’s approved application channel.

How long does a Dermot lease assignment take?

No universal Dermot assignment timeline surfaced. Allow time for route confirmation, marketing approval, tours, applicant screening, conditions, owner consent, documents, funds, insurance, inspection, and building move scheduling. The replacement should not treat a target date as guaranteed until the property confirms it.

Am I released when Dermot approves the applicant?

Not automatically. Application approval, final owner consent, signing, payment, effective transfer, possession, and release can occur at different stages. Continue performing the lease until the signed assignment, surrender, or replacement-lease package states when liability ends and resolves rent, charges, security, condition, and keys.

What happens to the security deposit in a Dermot assignment?

No universal Dermot deposit-transfer method surfaced in the public sources reviewed. Ask whether management returns the outgoing deposit, collects a new one, applies a documented credit, or expects a private reimbursement. Do not exchange deposit money privately until the management documents and apartment condition allocation are clear.

What if I leave a Dermot apartment without a signed release?

You may remain liable for rent and other lease obligations. New York Real Property Law § 227-e generally requires a residential landlord to take reasonable and customary steps to re-rent after a tenant vacates in violation of a lease, but mitigation is not prior consent, a fixed cancellation fee, or an automatic release.
