Breaking a UDR Lease: Buyout, Transfer or Sublet?

How to compare a UDR lease buyout, internal or inter-community transfer, roommate change, assignment, and sublet using current NYC property rules.

The short answer

A UDR lease exit is unusually property-specific. Current UDR pages publish a two-times-monthly-rent buyout fee at 10 Hanover Square and 21 Chelsea, transfer and relocation programs across the portfolio, and a formal roommate-change process. But the public terms differ by community. Start with your lease and the exact building page, then obtain a written route, quote, and release from that community before advertising or moving.

10 Hanover / 21 Chelsea buyout2× monthly rent
Applicant income baseline2.5× monthly / 30× annual
Guarantor baseline4× monthly / 48× annual
Your responsibility endsOnly as signed

Published UDR figures are evidence, not a quote. Fees, criteria, availability, and restrictions can change.

The essential distinction

UDR publishes useful rules, but they are not identical across NYC.

Published exampleWhat it showsWhy it does not answer every UDR lease
10 Hanover SquareTwo-month buyout; 2.5× applicant and 4× guarantor monthly incomeIts current page is building-specific
21 ChelseaTwo-month buyout; inter-community relocation listed without a feeSame-floorplan transfers are listed as unavailable
95 WallSame-floorplan transfer and inter-community relocation availableA relocation-program fee is listed
Columbus SquareSame-floorplan transfer; home-purchase buyout with 30 days' notice and two months' rentSpecial-purpose program and separate conditions

The safest rule is simple: never import the most favorable term from one UDR property into another application.

Confirm the property

The official UDR NYC portfolio currently lists five communities.

UDR's New York City apartment page currently identifies Columbus Square, 10 Hanover Square, View 34, 95 Wall, and 21 Chelsea. The community page is the first evidence layer; the signed lease, addenda, rent status, owner entity, and current written response remain controlling.

  • Upper West Side: Columbus Square, 808 Columbus Avenue.
  • Lower Manhattan: 10 Hanover Square and 95 Wall Street.
  • Murray Hill: View 34, 401 East 34th Street.
  • Chelsea: 21 Chelsea, 120 West 21st Street.

Step 1 · Get a transaction-specific answer

Ask the community to quote every available path in one response.

A useful opening request

“I need to leave apartment [number] around [date], before my lease ends on [date]. Please confirm whether my current lease qualifies for a lease buyout, same-community transfer, UDR Relocation Guarantee, roommate change, assignment, approved sublet, replacement lease, or negotiated surrender. For each available route, please send the notice, fee, rent, concession, applicant, deposit, move-out, and release terms.”

Attach the lease and addenda. Ask the team to identify the contracting owner or landlord entity, not just the UDR brand.

Choose the route

Six UDR exit paths solve different problems.

RouteBest fitCore tradeoff
Contractual buyoutClean permanent exitKnown or quoted fee, notice, and conditions
Same-community transferDifferent unit, same buildingNew qualification, inspection, fee, and availability may apply
UDR relocationMove to another UDR communityEligibility, distance, deposits, and fees vary
Roommate changeSome leaseholders stayEvery remaining leaseholder may need to requalify
Assignment / replacement leaseNew renter takes possessionStructure and release require written approval
Approved subletTemporary absencePrime tenant usually stays liable

Published early termination

A two-month fee is documented at two UDR NYC properties—not proven portfolio-wide.

The current 10 Hanover Square and 21 Chelsea fee pages each list “Lease Buyout/Break Fee” at 2× monthly rent. That is unusually clear public evidence. It still leaves material questions:

  • How much written notice is required, and when may possession be returned?
  • Does ordinary rent continue through the effective date?
  • Are prior concessions, cleaning, damage, utilities, or monthly charges separate?
  • Does paying the fee itself create a release, or must a buyout agreement also be signed?
  • What happens if the quoted terms conflict with the signed lease or addendum?

Do not send a buyout payment based only on a web page. Obtain the apartment-specific ledger, agreement, effective date, and release language first.

Stay within UDR

Separate a same-building transfer from the No Hassle Relocation Guarantee.

UDR's relocation page advertises reduced or waived deposits and move-in fees for qualifying moves, including certain moves 30 or more miles away. Community pages add local restrictions and fee answers. A transfer is not complete until both the current and destination properties align the dates and documents.

QuestionWhy it matters
Is the destination eligible?A Greystar- or other manager-operated property is not automatically a UDR community
What is waived?Deposit, application, transfer, or other move-in charges are distinct
When does the old lease end?A new lease elsewhere does not by itself release the current lease
Do concessions carry?Specials generally attach to a particular apartment and lease

Partial household change

UDR’s published roommate process requires more than finding a substitute.

Current UDR lease-information pages say that a new leaseholder and all remaining leaseholders must apply and qualify. If one roommate leaves without a replacement, the remaining leaseholders must requalify. That makes income, credit, criminal-screening standards, fees, and signatures relevant to the whole continuing household.

Until the amendment is fully executed, the departing roommate should not assume that an email, key return, or private roommate agreement removed lease liability.

Applicant qualification

The current published NYC baseline is 2.5× monthly rent for applicants and 4× for guarantors.

UDR's qualification pages for 10 Hanover and View 34 describe total household gross monthly income of at least 2.5× rent and individual guarantor income of at least 4× rent.

Monthly rentApplicant annual equivalent (30×)Guarantor annual equivalent (48×)
$4,000$120,000$192,000
$5,000$150,000$240,000
$6,500$195,000$312,000

These are arithmetic equivalents of the published monthly multiples, not a promise of approval.

Step 2 · Build a complete file

UDR says it targets a decision within 48 hours after receiving a complete application.

That clock depends on completeness and verification. Current UDR pages identify the following baseline:

  • Every applicant and prospective occupant age 18 or older submits an application.
  • Leaseholders provide current government-issued photo identification.
  • Income records are provided within 48 hours after request and verified through Snappt.
  • Credit, rental history, bankruptcy, identity, and other screening factors are reviewed.
  • Before move-in, UDR publishes a $200,000 personal-liability insurance requirement, subject to stated exceptions.

Ask whether the buyout, transfer, roommate, assignment, or replacement-lease route changes any part of that package.

Model the whole transaction

Keep application, exit, recurring, and deposit amounts in separate columns.

CategoryPublished exampleConfirmation needed
Screening$20 per adult applicant on reviewed NYC pagesWho applies and when payment is due
Buyout2× monthly rent at 10 Hanover and 21 ChelseaAvailability and complete surrender balance
SecurityOften $1,500 or an advertised third-party alternativeOutgoing accounting and incoming requirement
Recurring chargesAmenity, technology, trash, insurance, utilities, and other items varyWhich continue through the effective date

Permanent replacement

If UDR will consider an assignment, define the legal structure before marketing.

An “apartment takeover” listing could result in an assignment of the remaining lease, a cancellation paired with a new lease, or a roommate amendment. Those are not interchangeable. Ask which document will be used, whether the original rent and expiration survive, whether renewal is offered, and whether every outgoing tenant receives an express release.

Under Real Property Law § 226-b, assignment requires written owner consent. A reasonable refusal means no assignment and no statutory release; an unreasonable refusal can entitle the tenant to release on request with 30 days' notice. Because that remedy turns on facts and procedure, obtain legal advice before relying on it in a disputed case.

Temporary absence

A sublet preserves the prime lease and usually preserves the prime tenant’s liability.

For qualifying rentals in buildings with four or more residential units, § 226-b provides a written request process. The packet generally needs the sublet term, proposed subtenant, reason, temporary address, co-tenant or guarantor consent, and proposed agreement. Follow the statute, the lease, and the property's delivery instructions precisely.

A sublet is usually the wrong route for a permanent departure. The prime tenant remains responsible for rent, damage, and lease compliance unless the owner signs something different.

Closing discipline

Track approval, signing, payment, possession, and release as separate checkpoints.

  • Route approval: the community authorizes the particular transaction.
  • Applicant approval: every required person clears the current review.
  • Documents: all tenants, guarantors, owner parties, and incoming renters sign.
  • Money: rent, fee, deposit, proration, concession, and final balance are reconciled.
  • Possession: inspection, insurance, keys, access, and move logistics are completed.
  • Release: the final writing states when each outgoing tenant's future liability ends.

If no agreement is reached

Mitigation limits damages; it does not convert an unauthorized move into an approved exit.

Under Real Property Law § 227-e, a residential landlord generally must take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease. Rent obtained from a new tenant reduces the former tenant's exposure. The rule does not promise immediate re-rental or erase other valid obligations.

Review possible protected exits in the citywide NYC guide and seek legal advice when rights or liability are contested.

Avoidable errors

Five mistakes that make a UDR exit harder.

  1. 1

Assuming every UDR building has the same buyout

The public pages themselves show meaningful community-level differences.

  2. 2

    Calling every move a transfer

Same-building transfer, UDR relocation, roommate change, and assignment are different transactions.

  3. 3

Using the 48-hour review target as a move-in promise

It applies to a complete application, not the whole exit and handoff.

  4. 4

    Ignoring recurring fees and concessions

The base rent or buyout fee may not equal the complete balance.

  5. 5

    Stopping at applicant approval

Only the completed agreement defines release and the end of liability.

Process overview

A disciplined UDR lease exit moves through seven stages.

  1. 1

    Identify the lease

Gather the lease, addenda, owner entity, apartment status, and expiration.

  2. 2

    Compare routes

Request buyout, transfer, relocation, roommate, assignment, and sublet answers.

  3. 3

    Obtain the numbers

Get notice, rent, fees, concessions, deposits, and release terms in writing.

  4. 4

    Market if needed

Advertise only the approved rent, term, dates, qualifications, and structure.

  5. 5

    Submit a complete file

Use UDR's issued workflow and respond quickly to verification requests.

  6. 6

    Close the documents

Resolve conditions, money, insurance, signatures, and release.

  7. 7

    Complete the handoff

Document condition, keys, access, inspection, and final accounting.

Frequently asked questions

UDR lease buyout, transfer, assignment, and sublet questions.

Can I break a UDR lease early?

Possibly. UDR currently publishes a lease buyout or break fee equal to two times monthly rent for 10 Hanover Square and 21 Chelsea, but it does not display that fee on every NYC community fee page reviewed. UDR also publishes internal and inter-community transfer options. Your lease, addenda, building page, and a current written quote determine which route is actually available and what it costs.

How much is the UDR lease buyout fee in NYC?

As reviewed on October 26, 2026, UDR’s public fee pages list a lease buyout or break fee of two times monthly rent at 10 Hanover Square and 21 Chelsea. The public fee pages reviewed for 95 Wall, View 34, and Columbus Square did not list a portfolio-wide buyout amount. Do not assume the two-month figure applies everywhere; request an apartment-specific written quote and conditions.

Does UDR allow transfers between its apartment communities?

UDR advertises a No Hassle Relocation Guarantee for moves between UDR communities, with reduced or waived deposits and fees in qualifying situations. Restrictions apply, and the community pages are not identical: 95 Wall says a participation fee applies, while 21 Chelsea says no relocation fee applies. Ask both the current and destination communities for the eligibility, distance, notice, fee, deposit, lease, and release terms.

Can I transfer to another apartment in the same UDR building?

It depends on the property. UDR’s current lease-information pages say same-floorplan transfers are allowed with management approval at 95 Wall and Columbus Square, but not at 21 Chelsea. That difference is why an answer from one UDR building should not be treated as a company-wide rule.

What income does a UDR replacement applicant need in NYC?

Current UDR qualification pages for 10 Hanover Square and View 34 say applicants need combined gross monthly income of at least 2.5 times monthly rent, equivalent to 30 times rent annually. Guarantors need individual gross monthly income of at least four times rent, equivalent to 48 times annually. Confirm the current standard for the exact community and transaction.

What is UDR’s application fee in New York City?

The NYC UDR fee pages reviewed list a $20 fee per adult applicant. That screening fee is separate from any buyout, transfer, roommate-change, deposit, insurance, moving, cleaning, amenity, technology, or other charge. Fees and requirements are expressly subject to change.

How does UDR verify income?

UDR’s current qualification pages say prospective leaseholders must provide acceptable proof of income within 48 hours after it is requested and that UDR uses Snappt for verification. Applicants may upload documents or connect payroll and bank information through the approved workflow. Use only the application link and instructions issued for the specific transaction.

Can I remove or add a roommate on a UDR lease?

UDR publishes a defined requalification process. When a new leaseholder moves in, the new person and all remaining leaseholders must apply and qualify; fees may apply. When a leaseholder moves out, all remaining leaseholders must requalify. Management approval and the completed lease documents are still required.

Does UDR allow lease assignments?

UDR’s public NYC pages reviewed focus on buyouts, internal transfers, inter-community relocation, and roommate changes rather than publishing one company-wide assignment procedure. Ask the property whether it will consent to an assignment of the remaining term or instead requires a buyout or new lease. Written owner consent is required under New York Real Property Law § 226-b.

Can I sublet a UDR apartment in NYC?

Ask the UDR community for written consent and follow the lease and New York Real Property Law § 226-b. For qualifying apartments in buildings with four or more residential units, the statute provides a detailed written-request process and limits unreasonable withholding. The prime tenant normally remains liable throughout an approved sublet.

Is a UDR transfer the same as a lease assignment?

No. An internal transfer usually ends or changes the current tenancy and starts a lease for another apartment. An assignment transfers the remaining interest in the existing lease to an incoming renter. A UDR inter-community relocation is another distinct program. The documents determine rent, term, deposits, fees, concessions, and release.

Does the two-month UDR buyout fee cover everything?

Not necessarily. A published fee is not a complete surrender agreement. Ask whether rent continues through a notice or move-out date, whether concessions are recaptured, whether cleaning or damage is separate, when the fee is due, whether it is refundable, and exactly when future liability ends. Rely on the signed buyout or surrender document.

What happens to my UDR security deposit?

UDR’s NYC pages commonly publish a $1,500 deposit or a third-party deposit alternative for regular new leases, but that does not establish one universal exit accounting method. Ask whether the deposit will be returned, credited, applied under the signed agreement, or replaced by the incoming renter. Keep deposit accounting separate from any private reimbursement.

How long does a UDR lease exit take?

UDR’s qualification pages say the company strives to decide complete applications within 48 hours, but that is not a full lease-exit timeline. Route approval, notice, quote acceptance, applicant review, signatures, insurance, funds, inspection, and move scheduling can add time. Build backward from a confirmed effective date rather than promising possession based only on application timing.

Am I released when UDR approves the new renter?

Not automatically. Screening approval is different from owner consent, completed documents, payment, possession, and release. Keep performing the current lease until a signed buyout, transfer, assignment, surrender, or replacement-lease package states the effective date and resolves rent, fees, security, condition, keys, and continuing obligations.

What if I move out without a signed UDR agreement?

You may remain liable under the lease. New York Real Property Law § 227-e generally requires a residential landlord to take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease, but mitigation is a damages rule—not advance permission to leave, a fixed buyout, or a guaranteed release date.
