The short answer
Multiple recent Gotham Point listings document management-approved lease assignments, sometimes with a new one-year lease option. That is strong building-level evidence, but Gotham does not publish one portfolio-wide exit policy. Ask your property team to confirm the transaction, rent, term, application, costs, renewal, security, and exact release before advertising or handing over possession.
This guide labels official Gotham facts and third-party transaction evidence separately. Listings can prove that a type of deal was marketed at a specific building; they cannot establish a current universal rule, fee, income standard, or approval promise.
Evidence check
Gotham's portfolio is official; Gotham Point assignment details are building-specific evidence.
| Evidence | What it establishes | What it does not establish |
|---|---|---|
| Official Gotham property site | Current rental portfolio and property teams | One exit policy across every building |
| Official Gotham Point page | Property identity, location, and management brand | Assignment pricing or applicant rules |
| Multiple 2025–2026 assignment listings | Gotham Point has processed or marketed approved assignments | Guaranteed approval for a new request |
| Listing-level applicant descriptions | Useful pre-screening clues | Official or portfolio-wide qualification policy |
Know the property
Do not turn Gotham Point evidence into a rule for Gotham West, The Ashland, or another building.
Gotham's official rental portfolio lists The Maybury, The Suffolk, Gotham West, Atlas New York, The Nicole, AIRE, Gotham Point, and The Ashland across Manhattan, Queens, and Brooklyn. Property ownership entities, affordable components, lease forms, concessions, and application systems can differ.
Start with the executed lease. Use its owner name and notice address for formal communications, then route the operational request through the resident portal or on-site Gotham team.
Step 1 · Ask management
Request both the remaining-term assignment and any fresh-lease alternative.
Identify the building, apartment, leaseholders, lease end date, target date, reason, and whether everyone or only one roommate leaves. Ask for a side-by-side comparison because Gotham Point listings show that a remaining-term assignment and a new one-year lease can produce different economics.
Opening request
“I need to leave apartment [number and property] around [date], before the lease ends on [date]. Please confirm whether management will consider a remaining-term assignment, a replacement lease, roommate change, temporary sublet, or negotiated termination, and provide the approved rent, dates, renewal, application, qualification, costs, security, timing, and release for each available route.”
Compare the routes
“Takeover” can mean at least four different Gotham transactions.
| Route | Best fit | Key risk |
|---|---|---|
| Remaining-term assignment | Permanent move with current end date | Renewal and release must be explicit |
| Replacement lease | Gotham offers a fresh term | Rent and concessions may change |
| Roommate amendment | One tenant stays while another leaves | Departing tenant may not be released automatically |
| Sublet | Temporary absence with planned return | Prime tenant remains responsible |
| Negotiated termination | Direct early exit | Fee or continuing obligations require written settlement |
Gotham Point evidence
Repeated assignment listings reveal the questions to ask—not a guaranteed template.
An October 2026 Gotham Point listing, now marked unavailable, described ownership or management approval, a $20 applicant fee, ID, employment or income proof, bank statements, guarantor support, a fixed end date, and an outgoing-tenant credit. A separate landlord-verified 2026 listing offered both a short remaining-term assignment and a new one-year lease. Those differences are the evidence: there is no safe generic offer.
| Reviewed Gotham Point example | Listing-level terms | What to verify now |
|---|---|---|
| October 2026 one-bedroom | Remaining term, renewal shown, $20 application, tenant-funded credit | Availability, gross rent, credit delivery, screening, renewal, and deposit |
| Landlord-verified 2026 three-bedroom | Short assignment plus separate one-year-lease option | Which structure, new rent, concessions, documents, and release |
- Ask which term: existing end date, renewal option, or new lease.
- Ask which rent: gross rent, net-effective presentation, concessions, or new pricing.
- Ask which criteria: income, credit, assets, guarantor, and affordable-program eligibility.
- Ask which costs: screening, security, amenities, moving, concessions, and assignment administration.
Every figure in this section is third-party listing evidence unless Gotham confirms it for the current apartment.
Permanent replacement
Build the listing around the written Gotham offer.
Confirm
Route, rent, dates, renewal, qualification, fees, security, and release.
Market
Use accurate apartment details and label the deal subject to management approval.
Close
Send one complete file and finish documents, funds, release, and move.
New York assignment law has limits. RPL § 226-b requires written owner consent. A reasonable refusal prevents the assignment. An unreasonable refusal can create a potential release remedy, not a right to force the proposed renter into the lease.
Roommate changes
Separate a partial household change from a full-apartment assignment.
List the departing leaseholder, continuing leaseholder, applicant, guarantors, adult occupants, pets, and deposit contributors. Ask whether the whole household must requalify and whether Gotham will use an amendment, assignment, or new lease. Approval of the incoming roommate is not proof that the outgoing tenant is released.
Applicant preparation
Prepare for common Gotham Point records, then replace the checklist with management's instructions.
- Identity: current government-issued photo ID for each applicant and adult occupant.
- Income: employment letter or offer, recent paystubs, or tax records for self-employed applicants.
- Assets: a complete recent bank statement if requested.
- Credit: authorization and any conditions issued after screening.
- Guaranty: personal or institutional guarantor package only if the property confirms acceptance.
Do not collect or email sensitive records through an unofficial channel. The incoming renter should use the application link issued for the transaction.
Costs and security
A $20 application fee does not answer the outgoing tenant's total exposure.
- Application: confirm the current per-person screening charge and guarantor charge.
- Lease economics: gross rent, concessions, proration, continuing rent, and renewal pricing.
- Exit costs: administrative, legal, assignment, termination, marketing, or concession repayment.
- Building costs: insurance, amenities, move scheduling, elevator, storage, keys, and damages.
- Security: outgoing accounting and incoming requirement can differ by transaction and applicant.
Show gross rent before effective rent. If the outgoing tenant funds a credit, write down the amount, payer, due date, conditions, and what happens if the start date changes or management does not approve the deal.
Temporary route
A Gotham sublet keeps a different liability structure from assignment.
For qualifying apartments in buildings with four or more units, § 226-b describes a certified-mail request containing the proposed term, subtenant name and addresses, reason, tenant's temporary address, required co-tenant or guarantor consents, proposed sublease, and lease copy if available. The prime tenant normally remains liable after approval.
Affordable, rent-stabilized, subsidized, and other regulated Gotham apartments can have additional eligibility, rent, and primary-residence restrictions.
Approval and release
Finish the deal in the order the final documents require.
- 1
Applicant approval
Clear every income, credit, asset, guarantor, occupant, pet, and document condition.
- 2
Owner documents
All required parties sign the assignment, amendment, termination, or replacement lease.
- 3
Money and release
Resolve rent, fees, concessions, security, proration, and end of liability.
- 4
Possession
Finish condition, insurance, cleaning, keys, access, elevator, and scheduling.
If no agreement is reached
Mitigation can reduce damages, but it is not pre-approval to move.
Under RPL § 227-e, the residential landlord generally must take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease. A later re-rental can reduce damages, while disputes may remain over notice, vacancy rent, fees, concessions, condition, and marketing efforts.
Review potential protected rights in the NYC legal-exits section before relying on mitigation.
Avoidable mistakes
Six errors weaken a Gotham lease-exit file.
- 1
Assuming Gotham Point terms apply everywhere
Each property, owner entity, lease form, and apartment program can differ.
- 2
Calling every deal a takeover
State whether it is assignment, new lease, roommate amendment, sublet, or termination.
- 3
Marketing net rent without gross economics
Explain rent, concessions, credits, and who funds them.
- 4
Treating 40× as official policy
Use it only as a clue until management supplies the current criteria.
- 5
Assuming a renewal option
Listings show different renewal outcomes even within Gotham Point.
- 6
Moving before the release
Applicant approval does not itself end the existing lease.
End-to-end timeline
A Gotham lease exit moves through six stages.
- 1
Identify
Confirm property, owner entity, lease, program, household, and target date.
- 2
Request
Obtain available structures, economics, application, costs, and release.
- 3
Market
Publish only confirmed rent, term, renewal, dates, condition, and qualification.
- 4
Apply
Submit one complete file through Gotham's approved application channel.
- 5
Sign and settle
Complete documents, funds, security, concessions, and release.
- 6
Handoff
Document condition, cleaning, keys, access, insurance, and move logistics.

Frequently asked questions
Gotham Organization lease-break, assignment, and sublet questions.
Can I break a Gotham Organization lease early?
Possibly, but Gotham does not publish one portfolio-wide early-termination fee or automatic release policy. Multiple Gotham Point listings document management-approved assignments, showing that a building-specific process exists there. Ask the team for your property whether it will approve an assignment, replacement lease, roommate change, sublet, or negotiated termination.
Does Gotham allow lease assignments?
Multiple 2025 and 2026 Gotham Point listings identify the transaction as a lease assignment requiring Gotham Point management approval, and some listings say a new one-year lease was also available. That is meaningful building-level evidence, but it is not an official portfolio-wide policy. Obtain current written terms from your property team.
Is Gotham Properties the same as Gotham Organization?
Gotham Organization is the developer, owner, and management company, while Gotham Properties is the consumer-facing rental portfolio brand. The official property site lists Gotham rentals across Manhattan, Brooklyn, and Long Island City. Your executed lease may use a property-specific owner entity, which should be used for formal notices.
Which Gotham buildings are covered by this guide?
The process framework applies to Gotham-managed rentals, but the strongest assignment evidence reviewed comes from Gotham Point. Gotham’s official portfolio also lists The Maybury, The Suffolk, Gotham West, Atlas New York, The Nicole, AIRE, and The Ashland. Do not import Gotham Point terms into another property without written confirmation.
How much is the Gotham lease-assignment fee?
No universal official assignment or termination fee surfaced. Recent third-party Gotham Point listings commonly report a $20 applicant screening fee, but that is not proof of the outgoing tenant’s total cost. Ask management to itemize application, legal, administrative, concession, rent, security, move, amenity, damage, and any marketing amounts.
What income does a Gotham Point assignment applicant need?
Several Gotham Point assignment listings report a typical 40-times-monthly-rent income benchmark, but no current official portfolio policy surfaced. Treat 40× as a building-specific pre-screening clue, not a promise. The management-issued application and written criteria control the applicant, guarantor, credit, asset, and regulated-unit review.
What documents does a Gotham Point applicant need?
Recent Gotham Point assignment listings describe government photo ID, proof of employment or income, paystubs or an offer letter, and recent bank statements. Some mention guarantor programs. These are third-party descriptions, so the applicant should use only the secure link and checklist issued by Gotham management for the current transaction.
Can a Gotham assignment become a new one-year lease?
Some Gotham Point listings said the incoming renter could sign a new one-year lease instead of, or after, taking the remaining term. Other listings showed only the existing end date or no renewal. That variation is precisely why the approved rent, term, renewal, concessions, and structure must be confirmed for each apartment before marketing.
Does a Gotham Point lease assignment guarantee a renewal?
No. Reviewed Gotham Point listings show different outcomes: some stated that renewal was available, one offered a separate new one-year lease, and others described only the remaining lease term. Require management to state in writing whether renewal is available, when it would be offered, whether it is a new tenancy, and how rent would be set.
Who pays a concession on a Gotham Point lease takeover?
It depends on the written offer. One reviewed listing separated the gross lease rent from a cash credit funded by the outgoing tenant. A private incentive does not change the legal rent owed to Gotham. State the gross rent, credit amount, payer, payment date, conditions, and actual effective cost without presenting a tenant-funded credit as a landlord concession.
Can I replace one roommate in a Gotham apartment?
Ask for the property’s add-and-remove procedure. Identify the departing tenant, continuing tenant, incoming applicant, guarantors, and all occupants. Confirm who must requalify, whether Gotham uses an amendment or a new lease, how the deposit is handled, and whether the departing leaseholder is expressly released.
Can I sublet a Gotham apartment?
Ask Gotham for written consent and follow the lease and New York Real Property Law § 226-b. For qualifying apartments in buildings with four or more residential units, the law provides a detailed request process and limits unreasonable withholding. The prime tenant normally remains responsible during an approved sublet.
Is a Gotham lease takeover the same as assignment?
“Lease takeover” is the common listing phrase. A lease assignment transfers the remaining legal interest to an approved renter. Gotham may instead terminate the old lease and issue a new lease. The final documents determine the rent, term, renewal, security, and whether the outgoing tenant is released.
How long does a Gotham lease assignment take?
No universal public approval timeline surfaced. Allow time for route and price confirmation, marketing, a complete applicant file, credit and document review, conditions, signatures, funds, insurance, and move scheduling. A candidate should not give notice elsewhere until Gotham confirms the deal and move date.
Am I released when Gotham approves the applicant?
Not automatically. Management approval, owner consent, assignment or lease signing, payment, possession, and release can be separate events. Continue performing your existing lease until signed documents state the effective date and address rent, security, apartment condition, keys, and every open condition.
What happens to the security deposit?
Gotham Point listings report different security arrangements, so no universal transfer method should be assumed. Ask whether management returns the outgoing deposit, collects new security, applies a documented credit, or leaves a roommate reimbursement to the tenants. Match any private payment to the final documents.
What if I leave without a signed Gotham release?
You may remain responsible for rent and other obligations. New York Real Property Law § 227-e generally requires a residential landlord to take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease, but mitigation is not prior approval or a guaranteed release date.
