Breaking a Greystar Lease: Transfer, Assignment or Sublet?

How to approach a Greystar-managed NYC lease exit: identify the owner, compare transfer, assignment, sublet and termination, then document approval and release.

The short answer

There is no single “Greystar lease-break policy” for every NYC apartment. Greystar's own guidance says termination depends on the current lease and explains that Greystar may be the owner-manager or only the owner's agent. Community-level evidence is much more useful: Two Lincoln Square publishes detailed transfer and sublet rules, while active 20 Broad listings document assignments. Start with the owner entity, lease, and exact community.

Start with legal identity

Greystar can be the owner, the manager, or both.

Greystar's property-management transition FAQ expressly says it sometimes owns and manages a property and sometimes serves as agent for another owner. That distinction matters because the owner named in the lease holds the contractual rights, even when the on-site Greystar team administers the process.

  • Read the first page, notices clause, signature blocks, and every assignment or termination addendum.
  • Ask the community manager to identify the current legal owner and authorized signing party.
  • Preserve any written agreement from a prior manager; Greystar says documented existing terms remain effective.
  • Do not assume an application or new lease at another Greystar property releases the present owner's lease.

Confirm the community

Greystar’s NYC directory spans many separately branded properties.

The current Greystar New York City directory includes 20 Broad, 116 John, Oriana, The Essex, The Maverick, The Biltmore, 800 Sixth, The Octagon, Two Lincoln Square, The Sagamore, The Chelsea, The Dylan, Anagram NoMad, Anagram Gramercy, 461 Dean, and other Manhattan, Brooklyn, and Queens communities.

That breadth is exactly why a policy from one property should be labeled as evidence from that property, not as a Greystar guarantee.

Step 1 · Ask the on-site team

Request every available route and a complete written quote.

A concise opening request

“I need to leave apartment [number] around [date], before the lease ends on [date]. Please identify the current owner and confirm whether it will consider a contractual termination, same-community transfer, inter-property move, assignment, replacement lease, roommate change, approved sublet, or negotiated surrender. Please send the notice, rent, application, fee, concession, deposit, timing, and release terms.”

Include the property name and full apartment address in every escalation; Greystar’s resident support page requests those details to route inquiries.

Choose the route

Six common paths create different documents and liability.

RouteBest fitKey confirmation
Contractual terminationPermanent exit with a lease clause or quoted buyoutNotice, full cost, effective release
Same-community transferStay in the building, change apartmentEligibility, fee, inspection, new lease
Inter-property moveMove to another Greystar-managed communityWhether owners coordinate or treat it as two deals
AssignmentReplacement takes the remaining termOwner consent, existing rent, release
Replacement leaseOwner prefers a fresh tenancyNew rent, term, deposit, termination of old lease
Approved subletTemporary absenceRequest procedure and continuing prime-tenant liability

The clearest NYC community example

Two Lincoln Square publishes detailed transfer and sublet rules.

Greystar's corporate site identifies Two Lincoln Square as a Greystar-managed community. Its resident guide uses Greystar email addresses and currently publishes these terms:

Internal transferApproved sublet
At least 90 days in the existing apartmentFormal request with six categories of information
Requalify at 40× new monthly rentProposed sublessee completes screening
Updated documents, 30 days' notice, inspection$10 published application fee
$1,000 nonrefundable transfer fee; lease-break penalty may applyPrime tenant continues paying rent and amenity fees
No concessions; one transfer per lease termNo sublet during final 30 days; approval required

These are Two Lincoln Square's current published rules, not a promise for 20 Broad, The Octagon, 800 Sixth, or another Greystar-managed building.

Permanent replacement

20 Broad evidence shows that assignment and a new lease can coexist as options.

A current 20 Broad Leasebreak listing is labeled a lease assignment, says the tenant obtained landlord permission, provides a remaining term, and notes that a new one-year lease may also be available. Historical 20 Broad listings similarly distinguish assignment from a fresh 12-month lease.

  • Confirm whether the incoming renter may choose the remaining term, a new lease, or only one approved structure.
  • State gross base rent, recurring mandatory charges, incentives, dates, and renewal accurately.
  • Use only the property's application channel and payment instructions.
  • Require written release language for every outgoing tenant and guarantor.

Under Real Property Law § 226-b, an assignment requires written consent. A reasonable refusal means no assignment and no release; an unreasonable refusal can trigger a release remedy on request with 30 days' notice. Obtain legal advice before relying on that remedy in a dispute.

Step 2 · Build the applicant file

Use the exact community criteria and current portal.

No portfolio-wide NYC income multiple surfaced. A prepared replacement should nevertheless assemble:

  • Government-issued identification for each applicant and required occupant.
  • Current employment, pay, tax, self-employment, housing-assistance, or asset records as applicable.
  • Complete bank statements and rental-history information if requested.
  • Guarantor or third-party guaranty materials only if accepted by the community.
  • Pet, insurance, occupancy, move, and any regulated-apartment documents.

Two Lincoln's 40× rule is a useful property-specific example, not a substitute for another community's criteria.

Model the full cost

Greystar now displays more all-in pricing, but exit costs still require a direct quote.

The current 20 Broad page separates base rent from mandatory monthly costs and publishes a $20 applicant fee, a property-specific security amount, and recurring items such as a $75-per-leaseholder community amenity fee for reviewed units. Those figures illustrate why base rent alone does not describe the transaction.

Cost categoryQuestions to answer
Termination or transferFee, rent-through date, notice, concession recapture, and release
ApplicationAmount per person, refundability, and correct payment recipient
Monthly chargesAmenity, technology, insurance, utilities, pets, storage, and other mandatory items
SecurityExisting holder, new requirement, transfer or refund method, and condition deductions
Private incentiveAmount, schedule, legality, and written treatment separate from the owner's lease

Temporary absence

Greystar’s general guidance and New York law both point to written permission.

Greystar's subleasing guide says the original tenant keeps the prime lease and advises checking the lease and getting permission. In qualifying New York buildings with four or more residential units, § 226-b provides a specific request process and restricts unreasonable withholding.

A property's process can be more detailed. Two Lincoln Square requires a proposed agreement, applicant screening, co-tenant or guarantor consent, and the tenant's temporary address, and it keeps rent and amenity-payment responsibility with the prime tenant.

Closing discipline

Verify authority as well as applicant approval.

  • Owner authority: confirm the entity and person authorized to consent and release.
  • Route approval: document assignment, transfer, sublet, replacement lease, or termination.
  • Applicant approval: clear screening and every condition for all required people.
  • Documents and money: complete signatures, rent, fees, security, insurance, and final balance.
  • Possession and release: align effective date, condition, keys, access, move logistics, and liability end date.

If no agreement is reached

Mitigation applies after breach; it is not a substitute for advance approval.

Under Real Property Law § 227-e, the residential landlord generally must take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease. Rent from the new tenancy reduces damages, but the former tenant can remain exposed during a reasonable vacancy and for other valid amounts.

Review possible protected exits in the complete NYC guide before treating an ordinary breach as the only option.

Avoidable errors

Five mistakes to avoid in a Greystar-managed lease exit.

  1. 1

Treating Greystar as the owner without checking

The lease entity and authority determine who can consent and release.

  2. 2

    Applying one property's policy everywhere

Two Lincoln Square's excellent detail remains property-specific.

  3. 3

Assuming a move to another Greystar building is automatic

Separate owners can mean separate applications, leases, deposits, and terminations.

  4. 4

Advertising base rent without required charges

State the approved economics and explain any incentive accurately.

  5. 5

    Stopping at screening approval

Authority, documents, funds, possession, and release still must close.

Process overview

A Greystar-managed lease exit moves through seven stages.

  1. 1

    Identify owner and lease

Gather parties, clauses, addenda, apartment status, and expiration.

  2. 2

    Contact the community

Ask for every route and the person authorized to approve it.

  3. 3

    Compare terms

Model notice, cost, rent, recurring fees, deposits, dates, and release.

  4. 4

    Market accurately

Use the approved structure, qualifications, total price, dates, and disclosures.

  5. 5

    Apply completely

Use the correct portal and satisfy all applicant and property conditions.

  6. 6

    Sign and fund

Complete authorized documents, balance, security, insurance, and release.

  7. 7

    Coordinate possession

Finish inspection, condition, access, keys, and building move procedures.

Frequently asked questions

Greystar lease-break, transfer, assignment, and sublet questions.

Can I break a Greystar lease early?

Possibly, but Greystar’s own transition FAQ says early termination depends on the current lease. Greystar sometimes owns and manages a property and sometimes acts only as the owner’s management agent. The signed lease, owner entity, addenda, community policy, and current written offer determine whether a buyout, transfer, assignment, replacement lease, sublet, or negotiated surrender is available.

Is Greystar my landlord or only the property manager?

Either is possible. Greystar publicly states that in some cases it is both owner and manager, while in others it is the management agent for a separate owner. Read the parties, notices, and signature blocks in your lease and ask the on-site team to identify the contracting owner. Approval and release must come from the legally authorized party.

Does Greystar have one lease-break fee?

No reliable company-wide NYC fee surfaced. Greystar says termination depends on the lease, and published community policies vary. Two Lincoln Square warns that a lease-break penalty may apply to a transfer but does not publish a universal amount on that page. Ask for an apartment-specific written quote, its expiration date, and the complete release conditions.

Can I transfer to another apartment in a Greystar-managed building?

It depends on the community. Two Lincoln Square currently publishes a transfer route requiring at least 90 days in the existing apartment, 40 times rent income, updated documents, 30 days’ notice, inspection, a $1,000 nonrefundable transfer fee, no concessions, and no more than one transfer per lease term. A lease-break penalty may also apply. Do not assume those terms apply elsewhere.

Can I transfer from one Greystar property to another?

Greystar does not publish one universal NYC inter-property relocation guarantee comparable to UDR’s program in the sources reviewed. Because different Greystar-managed communities can have different owners, an inter-property move may be two separate transactions: ending the old lease and qualifying for a new one. Ask both communities for written coordination and do not assume the new lease releases the old one.

Does Greystar allow lease assignments in NYC?

Property-level evidence shows assignments occur at Greystar-managed NYC buildings. A current 20 Broad Leasebreak listing is labeled a lease assignment, says the tenant has landlord permission, and states that a new one-year lease may also be available. Historical 20 Broad listings likewise document both remaining-term assignment and new-lease choices. The exact building must still approve the transaction.

Can I sublet a Greystar apartment in NYC?

Ask the community for written consent and follow the lease and New York law. Greystar’s own subleasing article advises residents to check the lease and obtain permission. Two Lincoln Square publishes a detailed sublet process: a formal request, proposed agreement, a $10 applicant fee, screening, and no sublet during the final 30 days; the prime tenant remains liable. Those details are property-specific.

What are the Two Lincoln Square sublet rules?

The current property guide requests the sublet term, proposed sublessee’s name and address, the reason, the tenant’s temporary address, written co-tenant or guarantor consent, and the proposed sublease. It says the proposed sublessee applies for a $10 fee, the tenant continues paying rent and amenity charges, the final 30 days cannot be sublet, and all sublets require approval.

What income does a Greystar NYC applicant need?

No reliable portfolio-wide Greystar NYC multiple surfaced. Two Lincoln Square publishes 40 times monthly rent for its internal-transfer qualification, but that is a community rule and does not prove every Greystar building or assignment uses 40×. Request the exact current standard for the property, transaction, household, guarantor, and apartment program.

What is Greystar’s NYC application fee?

Current 20 Broad cost calculators publish a $20 application fee per applicant for ordinary new rentals. Two Lincoln Square publishes a $10 sublet-applicant fee. These are different property and transaction examples, not one portfolio schedule. Confirm every application, transfer, termination, moving, amenity, insurance, deposit, and recurring charge before anyone pays.

Is a Greystar transfer the same as a lease assignment?

No. A transfer generally moves the existing resident to a different apartment and usually creates new lease documents. An assignment transfers the remaining interest in the current lease to a replacement renter. A replacement lease ends one tenancy and starts another. A sublet leaves the prime lease in place. The final document—not the listing label—controls.

Does a change to Greystar management cancel my current lease?

No. Greystar’s published transition FAQ says the existing lease remains valid when Greystar begins managing the property, and its terms continue until renewal. Written agreements from the prior management should be documented and presented. A management change alone is not a lease release.

What happens to the security deposit in a Greystar lease exit?

The answer depends on the owner, property, and transaction. A transfer can require new security or documented movement of funds; an assignment can involve owner-held funds or a private reimbursement; a surrender triggers final accounting. Ask who holds the existing deposit, what the incoming renter pays, and how condition deductions and the outgoing refund will be documented.

How long does a Greystar lease exit take?

No universal timeline surfaced. Two Lincoln Square’s internal-transfer policy alone requires 30 days’ notice and an inspection, while an assignment or sublet also requires route approval, marketing, screening, documents, funds, and move coordination. Work backward from the required notice and do not promise possession until the on-site team confirms the effective date.

Am I released when Greystar approves the replacement?

Not automatically. Applicant approval, owner consent, document execution, payment, effective transfer, possession, and release are separate. Continue performing the current lease until the signed assignment, surrender, termination, transfer, or replacement-lease package states the exact liability end date and resolves rent, fees, security, condition, and keys.

What if I leave a Greystar-managed apartment without a signed agreement?

You may remain liable under the lease. New York Real Property Law § 227-e generally requires the residential landlord to take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease, but that duty mitigates damages; it does not give advance permission, set a fixed fee, or guarantee when liability ends.
