The short answer
Durst does not publish one portfolio-wide lease-break policy, but multiple 2026 transactions show real assignment paths at Halletts Point, VIA 57 WEST, and HELENA. A current Halletts Point offer also presents a new one-year lease as an alternative. Confirm the building's preferred structure, advertising permission, applicant rules, money, renewal, and release before finding a renter.
The evidence is property-level. It supports asking for these routes, not assuming one Durst-wide price, process, or approval.
Evidence hierarchy
Official portfolio facts and verified transactions answer different questions.
| Evidence | What it supports | What remains open |
|---|---|---|
| Official residential portfolio | Durst operates nearly 4,000 rental residences | No universal exit policy |
| Current 20 Halletts Point listing | Assignment and alternative new lease | Another apartment's terms |
| Landlord-verified VIA example | Remaining-term assignment and renewal opportunity | No standing guarantee |
| Landlord-verified HELENA example | Assignment route and renewal evidence | Current fee and qualification |
Confirm the property
Durst's residential portfolio is large enough that building-level precision matters.
The official portfolio describes nearly 4,000 rental residences and includes VIΛ 57 WEST, HELENΛ, FRΛNK, EŌS, Sven, and Halletts Point. Check the owner and manager named in your lease and portal. Affordable, rent-regulated, market-rate, and property-specific programs can change who may take the apartment, how rent is handled, and whether assignment, sublet, or a new lease is available.
| Property | Official leasing contact | Useful current evidence |
|---|---|---|
| Halletts Point | 929-373-5555 · HLPleasing@durst.org | Current assignment/new-lease choice |
| VIA 57 WEST / 57 WEST | 212-789-5757 · 57westleasing@durst.org | Landlord-verified assignment |
| Sven | 718-751-3456 · svenleasing@durst.org | Historical route examples; reconfirm |
Step 1 · Contact the building
Request the live terms from the property team before advertising.
Provide the building, apartment, lease entity, every signer, end date, target move date, household change, apartment condition, and reason for leaving. Ask for assignment, replacement-lease, roommate-change, sublet, surrender, and any direct cancellation route.
Opening request: “Please provide the current written options for leaving apartment [number] around [date], including assignment of the remaining term and a new lease for an approved replacement. Please state rent, term, renewal, application, qualification, every fee, security, marketing permission, timing, move requirements, and the document and date that release every outgoing signer.”
Compare the routes
Choose by liability, total economics, and future term—not the phrase “takeover.”
| Route | Incoming renter | Departing tenant |
|---|---|---|
| Assignment | Takes approved remaining term | Needs express release |
| New lease | Signs fresh Durst lease | Needs signed termination |
| Sublet | Temporary subtenant | Normally remains prime tenant |
| Roommate change | One household member changes | Departing signer needs release |
| Surrender | May be unnecessary | Exits on negotiated written terms |
2026 assignment evidence
Three properties create a useful pattern without establishing a universal policy.
- 20 Halletts Point: an October 2026 assignment through July 31, 2027, with renewal and a new one-year lease alternative advertised.
- VIA 57 WEST: a landlord-verified 2026 assignment of the remaining term with a renewal opportunity.
- HELENA: a landlord-verified 2026 assignment and renewal example.
- 10 Halletts Point: another 2026 listing references a $20 credit/background check, useful only as a building-level clue to reconfirm.
This is materially stronger than one anonymous forum post: the transactions are recent, property-specific, and in two cases landlord verified. Still, rent, term, apartment program, application, fee, renewal, and release must be obtained for the apartment now being transferred.
Direct Sven experience
David has marketed a real Sven lease exit—not just researched the building from public pages.
A verified 2024 listing posted by David Aharoni for Sven apartment 54D offered the home furnished or unfurnished and described a furnished sublet or lease-assignment path with a renewal option. The archived listing confirms direct experience presenting a Durst-property exit, handling structure ambiguity, and marketing the remaining term.
Evidence boundary: the Sven transaction is useful first-hand experience, not today's policy sheet. Current rent, route, documents, fees, qualification, approval, and renewal must still come from the building team for the apartment at issue.
Marketing permission
Durst's own site makes written content permission especially important.
The official residential page says Durst property information may not be republished without written consent. It also states that third-party brokers are not acting for Durst without an agreement and that renters should pay only properly disclosed fees. Obtain approval for photos, floor plans, building copy, rent, concessions, dates, application instructions, broker role, and fee disclosures before a listing goes live.
Safer listing language: “Proposed assignment or replacement lease, subject to Durst approval and final building terms.” Avoid implying that management sponsors the listing unless it does.
Permanent replacement
Package the assignment and new-lease choices as separate offers.
For an assignment, confirm the remaining term, existing rent, apartment status, renewal opportunity, start date, condition, furniture, incentives, application, fees, security, and release. For a new lease, obtain its own rent, duration, concessions, renewal framework, security, and qualification. Do not blend the cheaper feature of one route with the more flexible term of the other.
Under RPL § 226-b, assignment requires written owner consent. If the owner reasonably withholds consent, there is no assignment and no statutory release. If consent is unreasonably withheld, the statute makes release on the tenant's request and 30 days' notice the sole remedy; it does not permit the tenant to install the proposed renter. Seek legal advice before relying on that remedy.
Roommate changes
A partial household change needs its own written treatment.
Tell the property team who is remaining, departing, and joining. Ask whether it will use an amendment, roommate change, partial assignment, occupant approval, or new lease. Confirm whether the continuing household requalifies, whether rent or expiration changes, and how guarantors, security, balances, renewal, apartment condition, and the departing signer's release are handled.
Rent-stabilized checkpoint: HCR says a remaining named tenant is entitled to a renewal in their own name when the other named tenant leaves. Replacing that person with a non-spouse is different: owner approval is required and a vacancy lease with lawful increases may result. Affordable units can add separate eligibility rules.
Step 2 · Applicant preparation
Use the checklist issued by the correct building and transaction.
The public sources reviewed do not establish a universal Durst transfer-income multiple. Ask for current standards covering identity, income, employment, assets, credit, guarantors, occupants, pets, and any affordable or regulated program. Then submit all required people through the building-approved application path.
- Identify assignment versus new-lease applicants correctly.
- Keep documents current, complete, legible, and consistently named.
- Explain variable income, self-employment, students, guarantors, and recent job changes.
- Preserve every approval condition and expiration date in writing.
Costs and security
Require one itemized statement for each proposed structure.
Ask about application, screening, management, legal, transfer, guaranty, broker, pet, amenity, insurance, moving, rent, concession, damage, and security amounts. Identify who pays, the due date, refundability, conditions, and the result if the applicant is rejected or the transaction does not close.
The deposit treatment should be explicit: return to the outgoing tenant, ledger transfer, replacement by the new renter, continued retention, or a documented private reimbursement. Match that path to condition liability and the final move-out accounting.
If the transaction terminates the outgoing tenancy rather than transferring the deposit on management's ledger, current New York guidance generally provides a right to request an inspection and requires the deposit or an itemized lawful deduction statement within 14 days after move-out.
Temporary route
A sublet preserves the original lease—and usually the original tenant's exposure.
For qualifying apartments in buildings with four or more units, § 226-b sets a certified-mail request process. The request includes the proposed term, subtenant name and addresses, reason, tenant's temporary address, co-tenant or guarantor consent, proposed sublease, and lease copy if available. The owner may seek more information within ten days and generally must respond within thirty days after the request or additional information is mailed.
Affordable, regulated, or program units can have additional rent, eligibility, duration, and primary-residence rules.
Approval and release
Track the transaction through four separate approvals.
- 1
Offer
The building approves structure, rent, term, renewal, marketing, fees, and security.
- 2
Applicant
Every renter, guarantor, occupant, pet, and program condition clears review.
- 3
Documents
Owner, incoming renter, outgoing tenant, and any guarantor sign the required package.
- 4
Closing
Money clears and the agreed possession, condition, keys, and release become effective.
Release test
A complete Durst closing should identify the existing lease and apartment, name every outgoing signer and guarantor, state the effective release date and conditions, reconcile rent, fees, concessions and security, allocate condition claims, and document possession and keys. Applicant approval is only one checkpoint.
If no agreement is reached
New York's mitigation rule can limit damages after vacancy; it does not plan the exit for you.
Under RPL § 227-e, a residential landlord generally must take reasonable and customary steps to re-rent after a tenant leaves in violation of the lease. The parties can still dispute notice, access, listing, rent, condition, concessions, fees, and the date a replacement tenancy reasonably should have begun.
Also review protected grounds in the NYC legal-exits guide before negotiating only around replacement or payment.
Avoidable mistakes
Six assumptions weaken a Durst lease-exit file.
- 1
Applying one building's listing to the whole portfolio
Use each example as evidence to ask, then get live property terms.
- 2
Republishing Durst materials without consent
Obtain written permission for property content and marketing.
- 3
Blending assignment and new-lease economics
Compare each route as a complete, separate package.
- 4
Assuming income or fee rules
Use the current building checklist and itemized charges.
- 5
Promising renewal from a listing
Confirm renewal eligibility and any future terms in writing.
- 6
Treating approval as release
Liability ends only under the effective signed documents.
End-to-end timeline
A Durst lease exit moves through six documented stages.
- 1
Verify
Identify the lease entity, property team, apartment program, riders, and balances.
- 2
Request
Obtain assignment, new-lease, roommate, sublet, surrender, and cancellation options.
- 3
Market
Use approved content, economics, dates, qualifications, and disclosures.
- 4
Apply
Submit a complete building-specific file for every required person.
- 5
Sign and settle
Resolve documents, fees, rent, security, incentives, balances, and release.
- 6
Handoff
Document insurance, moving, condition, access, possession, keys, and final accounting.

Frequently asked questions
Durst, Halletts Point, VIA 57 WEST, HELENA, Sven, assignment, and sublet questions.
Can I break a Durst Organization lease early?
Possibly, but Durst does not publish one portfolio-wide early-termination menu in the official pages reviewed. Current 2026 evidence documents assignments at Halletts Point, VIA 57 WEST, and HELENA, while other examples show that a new lease may sometimes be an alternative. Ask the building team to quote every available route for your apartment.
Does Durst allow lease assignments?
Yes in documented apartment-specific cases. Current or landlord-verified 2026 listings identify assignments at 20 Halletts Point, VIA 57 WEST, and HELENA. Those examples are strong evidence that Durst properties process assignments, but they do not create automatic approval, identical pricing, or the same renewal terms for another apartment.
Can I assign a lease at Halletts Point?
A current October 2026 listing at 20 Halletts Point offers a nine-and-a-half-month assignment through July 31, 2027 and also mentions an alternative new one-year lease. Ask Hallets Point leasing whether either structure is available for your apartment, then confirm rent, start date, qualification, fees, security, renewal, and release.
Can I assign a lease at VIA 57 WEST?
A landlord-verified 2026 VIA 57 WEST listing documented an assignment of the remaining term and a renewal opportunity. That transaction supports asking, not assuming. Contact the 57 WEST leasing team for the apartment-specific process and require the final documents to state the effective transfer and outgoing tenant’s release.
Can I assign a lease at HELENA?
A landlord-verified 2026 HELENA listing documented an assignment and advertised renewal. Treat it as building-level evidence rather than a standing policy. Confirm the current structure, dates, rent, apartment status, qualifications, application, costs, security, renewal, and release directly with management.
Can I assign or sublet a Sven lease?
Historical Sven examples show both assignment and sublet language and, in one case, a choice between the remaining term and a new 12-month lease. Because those examples are older, ask Sven leasing for the live policy rather than quoting them as current terms. Affordable or regulated units can have additional restrictions.
Has David handled a Sven lease exit?
Yes. A verified 2024 listing posted by David Aharoni for Sven apartment 54D marketed a furnished or unfurnished sublet or lease assignment with an advertised renewal option. That direct transaction experience helps identify the practical questions, but it is historical evidence—not a representation that today’s Durst process, pricing, approval, or renewal terms are identical.
Is a Durst lease takeover an assignment or a new lease?
It can be either. A current Halletts Point listing offers an assignment or an alternative new one-year lease. An assignment transfers the remaining interest; a new lease requires termination of the old lease and creates fresh terms. The final documents determine rent, duration, renewal, security, concessions, and outgoing liability.
What income does a Durst replacement tenant need?
No official public source reviewed states one current portfolio-wide Durst income multiple for transfers. Do not assume a generic 40-times rule. Ask the specific building team for current income, credit, asset, employment, guarantor, occupant, pet, and housing-program requirements before presenting a candidate as qualified.
Is the Durst application fee $20?
One 2026 Halletts Point assignment listing references a $20 credit and background check, but that is third-party building-level evidence, not proof of every Durst property’s process or total charge. Confirm the current application and every separate transfer, legal, management, guaranty, security, moving, amenity, pet, or other cost in writing.
Can I advertise my Durst apartment?
Obtain written permission and approved terms first. Durst’s official residential page says its property information may not be republished without written consent and disclaims responsibility for third-party brokers absent an agreement. Confirm allowed photos, text, rent, incentives, dates, qualifications, broker role, fees, and disclosures before publishing.
Can I replace one roommate on a Durst lease?
Ask whether the building offers a roommate change, occupant addition, lease amendment, partial assignment, or replacement lease. State who is staying, leaving, and joining. Confirm who must requalify, whether rent or term changes, how security and guarantors are handled, and whether every departing signer receives an express written release.
Can I sublet a Durst apartment?
Ask for written consent and follow your lease and New York Real Property Law § 226-b. For qualifying apartments in buildings with four or more residential units, the law provides a detailed written request process and restricts unreasonable withholding. An approved sublet normally leaves the prime tenant responsible to the landlord.
How much does a Durst lease assignment cost?
No current official portfolio-wide assignment fee surfaced in the reviewed sources. Request an apartment-specific itemization covering application, screening, management, legal, transfer, rent, concessions, security, guaranty, moving, insurance, amenities, pets, and any broker compensation. Do not infer total cost from one listing.
What happens to the security deposit in a Durst assignment?
No universal public Durst deposit-transfer method surfaced. Ask whether the outgoing security is returned, credited on the ledger, retained until the original term ends, replaced with new funds, or handled through a documented private reimbursement. The papers should allocate apartment-condition risk and match the actual payment path. If the transaction ends your tenancy, ask how New York’s inspection, itemization, and 14-day return rules apply.
Can a Durst assignee renew?
Several 2026 assignment listings advertise renewal opportunities, but listing language does not guarantee renewal for another apartment. Confirm whether the incoming tenant will be eligible, whether the apartment is regulated or affordable, who will issue the offer, and whether any future rent or term is contractual.
Am I released when Durst approves the applicant?
Not automatically. Commercial approval, applicant screening, owner consent, signatures, cleared funds, commencement, possession, and release can be separate milestones. Obtain fully executed documents stating the exact date and conditions that end each outgoing tenant’s liability, including rent, fees, concessions, security, condition, keys, and preserved claims.
What if I leave without a signed Durst release?
You may remain liable. New York Real Property Law § 227-e generally requires a residential landlord to take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease. That duty can limit damages, but it is not advance consent, an automatic cancellation, or a guaranteed date when liability ends.
