The short answer
Moinian does not publish one universal lease-break menu. The strongest current evidence is building-specific: one active 2026 SKY listing is classified as an assignment, reports landlord permission, and offers a choice between the remaining term and a new one-year lease; a second brokerage listing corroborates the assignment route. Ask the property team to confirm both structures, every dollar, and the document that releases you before marketing.
SKY transaction examples show what has happened at that building, not a universal promise for every Moinian property or apartment.
Evidence hierarchy
The route is well supported at SKY; the missing details still require management confirmation.
| Source | What it supports | Limit |
|---|---|---|
| Moinian portfolio | Property identity and portfolio scope | No lease-exit policy |
| SKY RentCafe page | Current property application and displayed $20 fee | Not total assignment pricing |
| October 2026 SKY listing | Assignment classification, tenant-claimed permission, and a new-lease alternative | Tenant-posted evidence for one apartment |
| 2026 brokerage listing | Independent evidence of another SKY assignment | Marketing copy, not executed documents |
Confirm the property
Start with the building and lease entity, not the Moinian name alone.
Moinian's official portfolio identifies SKY at 605 West 42nd Street, ARIA at 90–100 John Street, The Marc at 260 West 54th Street, 90W, Aria at 7 Platt Street, 1640 Flatbush Avenue, and other properties. Check the landlord and manager named in your lease, recent rent notice, portal, and payment instructions. The correct team and process may be property-specific.
Do not transplant the SKY evidence. Use it to ask a better question at another Moinian building, not to promise that the same route, price, or qualification applies.
Step 1 · Request both structures
Ask management to quote a remaining-term assignment and a replacement lease.
Identify the building, apartment, every signer, lease end, target transfer date, occupants, apartment condition, and reason for leaving. Ask whether the property will approve an assignment, terminate and re-lease, allow a sublet, negotiate surrender, or offer cancellation.
Opening request: “Please provide the current written terms for (1) an assignment of my remaining lease and (2) a new lease for an approved replacement, including rent, term, renewal, concessions, application, qualification, every fee, security, marketing permission, timing, moving requirements, and the exact document and date that release me.”
Compare the routes
“Lease takeover” can close as several legally different transactions.
| Route | Incoming renter | Departing tenant |
|---|---|---|
| Assignment | Takes the remaining term if approved | Needs an express release |
| New lease | Signs a fresh term at offered economics | Needs signed termination of old lease |
| Sublet | Temporary subtenant under prime lease | Normally remains liable |
| Roommate change | May join or replace one household member | Departing signer needs release |
| Surrender | May be unnecessary | Exits on negotiated written terms |
Current SKY evidence
A live 2026 offer shows why the final structure matters more than the listing label.
An October 2026 SKY listing identifies itself as an assignment, records the tenant's claim of landlord permission, runs through May 31, 2027, advertises a renewal opportunity, and offers an alternative new one-year lease. Its narrative also uses the word “sublease.” That inconsistency is common in consumer marketing and is exactly why the executed papers—not the headline—must control.
A separate 2026 Brown Harris Stevens listing marketed a SKY apartment as a lease assignment with an incentive. Together, the examples make an assignment request credible, but neither establishes a standing right, fixed fee, standard incentive, or guaranteed renewal.
Permanent replacement
Build one approved offer before spending money on marketing.
- Structure: remaining-term assignment or new Moinian lease.
- Economics: gross rent, legal rent if applicable, incentives, fees, security, and utilities.
- Dates: earliest start, existing expiration, new-lease term, and possession.
- Future: renewal eligibility and whether any future rent is confirmed.
- Approval: applicant, guarantor, occupants, pets, documents, and conditions.
- Release: exact trigger ending every outgoing signer's liability.
Under RPL § 226-b, an assignment requires written owner consent. If the owner reasonably withholds consent, there is no assignment and no statutory release. If consent is unreasonably withheld, the statute makes release on the tenant's request and 30 days' notice the sole remedy; it does not authorize the tenant to install the applicant unilaterally. Get legal advice before relying on it.
Roommate changes
Replacing one signer is a separate request from transferring the whole apartment.
State who is staying, leaving, and joining. Ask whether management will amend the existing lease, require the household to requalify, issue a new lease, or treat the change as a partial assignment. The document should identify continuing liability, release the departing signer if agreed, and address security, guarantors, occupants, renewal, balances, and apartment condition.
Rent-stabilized checkpoint: HCR says that when two named tenants are on a stabilized lease and one leaves, the remaining tenant is entitled to a renewal in their own name. Adding a non-spouse replacement is different: owner approval is required and, if approved, the owner may issue a vacancy lease with lawful increases. Confirm status before agreeing to a “roommate swap.”
Step 2 · Applicant file
Ask for the live property checklist; do not invent Moinian-wide screening rules.
The SKY RentCafe page currently displays a $20 application fee, but the reviewed official pages do not publish one universal transfer-income rule. Before pre-screening, obtain the required income, credit, employment, asset, ID, guarantor, occupant, pet, and housing-program criteria directly from the property.
- Use the application link assigned to the exact apartment and transaction.
- Submit every required adult and guarantor together where possible.
- Label variable, self-employed, student, and guarantor income clearly.
- Answer follow-up requests promptly and preserve approval conditions in writing.
Costs and security
Turn a vague approval into an itemized closing statement.
Separate the $20 SKY application fee from any transfer, management, legal, broker, guaranty, pet, amenity, moving, insurance, rent, concession, or damage amounts. Ask who pays each item, when it is due, whether it is refundable, and what happens if management rejects the applicant or the parties do not sign.
For security, require the paperwork and payment path to agree. A private deposit reimbursement can leave the wrong person exposed to later deductions unless management's ledger and the final condition allocation are explicit.
If the transaction terminates the outgoing tenancy instead of transferring the deposit on a management ledger, current New York guidance generally provides a right to request an inspection and requires the deposit or an itemized lawful deduction statement within 14 days after move-out.
Temporary route
Use a true sublet only when temporary occupancy and continuing liability fit the plan.
For qualifying apartments in buildings with four or more units, § 226-b provides a certified-mail request process. The request includes the term, subtenant identity and addresses, reason, tenant's temporary address, co-tenant or guarantor consent, proposed sublease, and a lease copy if available. The owner may request more information within ten days and generally must answer within thirty days after the request or additional information is mailed.
Regulated apartments, affordable units, and other programs may add rent, primary-residence, duration, and eligibility restrictions.
Approval and release
Approval is a sequence, not a single email.
- 1
Commercial approval
The building confirms structure, rent, dates, renewal, fees, security, and marketing.
- 2
Applicant approval
Every renter, guarantor, occupant, pet, and condition clears review.
- 3
Document approval
All required parties sign the assignment, termination, new lease, or sublet consent.
- 4
Closing
Funds clear; move, possession, condition, keys, and the outgoing release become effective.
Release test
The final package should identify the existing lease and apartment, name every outgoing signer and guarantor, state the release date and conditions, reconcile rent, fees, concessions and security, allocate condition claims, and document possession and keys. Applicant approval alone is not a release.
If no agreement is reached
Mitigation is a damages rule, not a substitute for a signed exit.
Under RPL § 227-e, a residential landlord generally must take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease. Disputes may remain over notice, access, condition, rent, fees, concessions, and when a replacement tenancy should have begun.
Review possible protected exits in the NYC legal-exits guide before assuming the only options are payment or replacement.
Avoidable mistakes
Six shortcuts create preventable SKY and Moinian lease-exit problems.
- 1
Calling every route a sublet
An assignment, replacement lease, and sublet allocate liability differently.
- 2
Applying SKY evidence portfolio-wide
Confirm the policy with the actual lease entity and building team.
- 3
Assuming a 40× rule
Use the current transaction-specific criteria management provides.
- 4
Treating $20 as the total cost
The published SKY application fee does not establish all transfer charges.
- 5
Promising renewal from listing copy
Ask management to confirm any renewal opportunity in the final package.
- 6
Stopping at applicant approval
The outgoing tenant needs executed documents and an effective release.
End-to-end timeline
A strong Moinian lease exit moves through six documented stages.
- 1
Verify
Identify the lease entity, manager, property team, apartment status, riders, and balances.
- 2
Request
Obtain assignment and new-lease terms, plus any sublet or surrender alternative.
- 3
Market
Publish only the approved structure, dates, rent, renewal, incentives, and qualifications.
- 4
Apply
Submit the complete property application for every required person.
- 5
Sign and settle
Resolve documents, fees, rent, concessions, security, balances, and release.
- 6
Handoff
Document insurance, move approval, condition, access, possession, and keys.

Frequently asked questions
Moinian, SKY, lease-assignment, new-lease, and sublet questions.
Can I break a Moinian Group lease early?
Possibly, but no public source reviewed states one portfolio-wide buyout or early-termination policy. A current SKY listing is classified as an assignment, reports landlord permission, and offers an alternative new one-year lease; a separate brokerage listing supplies additional assignment evidence. Ask the building team to quote assignment, replacement lease, sublet, surrender, and any direct cancellation route in writing.
Does Moinian allow lease assignments at SKY?
Current 2026 evidence supports assignments in specific cases. An October 2026 SKY listing classifies the transaction as a lease assignment, records the tenant’s claim of landlord permission, and offers either the remaining term or an alternative new one-year lease. Another 2026 brokerage listing marketed a SKY assignment. Those examples support asking for the route but do not constitute an owner-published policy or pre-approve another apartment.
Is a SKY sublease the same as a lease assignment?
No. A sublet normally leaves the prime tenant in place and responsible, while an assignment transfers the remaining lease interest if the landlord consents. A current SKY listing uses “sublease” in its marketing copy but classifies the listing as an assignment. Treat listing labels as leads only; the signed Moinian documents determine the legal structure.
Can the incoming SKY renter sign a new one-year lease?
A current October 2026 SKY listing offered a new one-year lease as an alternative to taking the remaining term. That can improve renewal certainty or timing, but rent, concessions, security, fees, start date, qualification, and the outgoing tenant’s release can differ. Ask whether that alternative is available for your apartment and obtain both offers side by side.
What income does a Moinian replacement tenant need?
No current official public source reviewed states one universal Moinian income multiple for lease transfers. Do not assume the common NYC 40-times rule or copy a requirement from another landlord. Ask the building team for the current income, credit, asset, guarantor, occupant, and documentation standards for the exact transaction.
Is the SKY application fee $20?
The current SKY RentCafe property page displays a $20 application fee. Confirm that this is the application used for your assignment or replacement lease and ask about every separate management, legal, transfer, screening, guaranty, security, amenity, pet, moving, and concession charge before the applicant pays.
How do I apply for a SKY lease takeover?
Use only the application link or RentCafe workflow issued or approved by SKY management. Confirm which adults must apply, the documents required, how guarantors and occupants are handled, the exact apartment and proposed start date, and whether the application is for the remaining term or a new lease. A complete file does not itself release the outgoing tenant.
Can I assign a lease at another Moinian building?
Ask that property’s leasing or management team. Moinian’s official portfolio includes SKY, ARIA, The Marc, 90W, 1640 Flatbush, and other properties, but building-level SKY evidence should not be presented as a portfolio-wide promise. The owner entity, manager, lease form, apartment program, and current policy may differ.
Can I replace one roommate on a Moinian lease?
Potentially, but that is not automatically the same as assigning the whole lease. Ask whether management offers a roommate change, occupant addition, partial assignment, lease amendment, or a replacement lease. Confirm who remains liable, who must requalify, whether the rent or term changes, and whether any departing signer receives a written release.
Can I sublet a Moinian apartment?
Ask for written consent and follow the lease and New York Real Property Law § 226-b. For qualifying apartments in buildings with four or more units, the law sets a detailed written request procedure and limits unreasonable withholding. Even when approved, a sublet normally leaves the prime tenant responsible for rent, damage, and compliance.
How much does a Moinian lease assignment cost?
No current official portfolio-wide assignment charge surfaced in the reviewed sources. The $20 shown on SKY’s property page is an application fee, not proof of the total transfer cost. Request an itemized apartment-specific quote covering application, management, legal, transfer, concessions, rent, security, guaranty, move, and building charges.
What happens to my security deposit?
No public source reviewed states one Moinian assignment-deposit method. Ask whether management returns the outgoing deposit, collects new security, documents a ledger credit, or permits a private reimbursement. The final papers should match the money flow and identify who bears later condition deductions. If the deal terminates your tenancy, ask how New York’s inspection, itemization, and 14-day return rules apply.
Can a SKY assignee renew the lease?
A current SKY assignment listing advertised a renewal opportunity, but a listing is not a renewal guarantee for another apartment. Confirm whether the incoming renter may renew, which entity will issue the renewal, whether the apartment is regulated, and whether any stated future rent or term is contractual rather than estimated.
How long does a Moinian lease assignment take?
No universal public timeline surfaced. Allow time to obtain written terms, market the approved offer, assemble every applicant and guarantor document, complete screening, clear conditions, sign all documents, settle funds, obtain moving approvals, and transfer possession. Keep performing the existing lease until the release is effective.
Am I released when Moinian approves the new renter?
Not automatically. Applicant approval, landlord consent, document execution, payment, commencement, possession, and release may occur at different points. Obtain a fully signed assignment, termination, or replacement-lease package that states the exact date your liability ends and resolves rent, concessions, fees, security, condition, and keys.
Can I market my Moinian apartment before approval?
Get written authorization and the approved commercial terms first. Confirm the structure, rent, remaining term, alternative new-lease terms, renewal, start date, furniture, incentives, applicant standards, photos, broker status, and disclosures. Advertising an unconfirmed “takeover” can produce applicants for a transaction management will not sign.
What if I move out without a signed Moinian release?
You may remain liable. New York Real Property Law § 227-e generally requires a residential landlord to take reasonable and customary steps to re-rent after a tenant vacates in violation of the lease, but mitigation affects potential damages; it is not advance permission to leave and does not create a guaranteed release date.
